By using the Services, requesting a quote, or otherwise providing information to us, you acknowledge that you have read this Privacy Policy. If you do not agree with our practices, please do not use the Services.

2. Information we collect

Information you provide directly

When you fill out a quote form, request a callback, or otherwise communicate with us, we collect information you choose to share. This typically includes:

• Name
• Phone number
• Email address
• Property address or service location (city, ZIP, or full address)
• Project details you share with us (fence material, approximate length, timeline, permit needs, photos or videos of your property)
• Best time to be contacted
• Any other information you voluntarily include in messages, forms, calls, texts, or emails

Information collected automatically

When you visit the Services, we and our service providers may automatically collect technical information about your device and browsing activity, including:

• IP address and approximate geographic location
• Browser type, language, and version
• Operating system and device type
• Referring URL and the pages you view on our site
• Time, date, and duration of your visit
• Click and scroll behavior, button presses, and form-field interactions

Information from third parties

• Comply with legal, regulatory, and tax obligations
• Detect, prevent, and respond to fraud, abuse, or security incidents
• Enforce our Terms of Service and protect our rights, property, and the rights of others

4. SMS & text messaging

By submitting your phone number through any form on the Services or by otherwise providing it to us, you authorize Happy Fence Company LLC to contact you by phone call and SMS/text message at the number you provided, including for informational and transactional messages related to your quote and service, and including by automated means (autodialer, automated text-message platform). Messages may relate to your quote, scheduling, service updates, follow-up calls, or related operational matters.

Message frequency varies. Message and data rates may apply depending on your mobile carrier and plan. Your consent to receive these messages is not a condition of any purchase.

To opt out of SMS messages from us at any time, reply STOP to any text message we send. You will receive a confirmation that you have been unsubscribed and will receive no further marketing or transactional SMS from us. To request help, reply HELP to any text message we send.

If you opt out of SMS, we may still need to contact you by phone or email about an active quote or installation. To stop all communications, contact us at office@happyfencecompany.com.

We do not share or sell SMS opt-in data

Happy Fence does not share, sell, rent, lease, trade, or otherwise transfer your mobile phone number, SMS opt-in information, or SMS consent records to any third party or affiliate for their marketing or promotional purposes. This no-sharing commitment applies to SMS opt-in data and consent information regardless of any other sharing described elsewhere in this policy. We use your phone number and the fact that you opted in solely to operate the message types you agreed to receive from Happy Fence Company LLC, and we disclose this information only to the SMS service providers that we use to route those messages on our behalf (for example, the SMS platform that physically delivers the text), and only as needed to deliver those messages to you.

Carriers are not liable for delayed or undelivered messages.

5. How we share your information

We do not sell your personal information. We share information only as described below.

SMS opt-in data is never shared with third parties for marketing. As stated in Section 4 above, we do not share, sell, rent, lease, trade, or otherwise transfer your mobile phone number, SMS opt-in information, or SMS consent records to any third party or affiliate for their marketing or promotional purposes. The categories of recipients described below do not include any party that would receive SMS opt-in data for its own marketing use.

With service providers

We share information with third-party vendors that help us operate the business, including (without limitation):

• Web hosting and content-delivery providers
• Form processing and workflow-automation platforms
• Marketing automation, CRM, and lead-management platforms
• SMS, voice, and email service providers (for example, services that route the calls and texts we send you)
• Analytics and advertising platforms (for example, Meta/Facebook for ad-attribution and audience tools)
• Payment processors (when applicable)
• Our installation crew, subcontractors, and partners who need information to complete a quote, walkthrough, or installation at your property
• Professional advisors such as accountants, lawyers, and insurers

These service providers are contractually limited to using your information for the purposes we authorize and are required to maintain reasonable security.

For legal reasons

We may disclose information if we believe in good faith that disclosure is required to comply with a legal obligation, enforce our agreements, protect the safety or rights of any person, or respond to claims that any content violates the rights of third parties.

In connection with a business transfer

If Happy Fence is involved in a merger, acquisition, financing, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of that transaction.

With your consent

We may share information for any other purpose disclosed at the time of collection or with your consent.

6. Cookies & tracking technologies

The Services use cookies, pixels, web beacons, local storage, and similar technologies to operate the site, remember your preferences, measure performance, and support advertising.

Types of cookies we use

• Strictly necessary — required for the site to function (for example, page caching, basic security).
• Analytics — help us understand how visitors use the site so we can improve it.
• Advertising and conversion tracking — help us measure and optimize our marketing on platforms such as Meta/Facebook and Google. These tools may set cookies that allow our advertising partners to show you ads on other sites and to attribute conversions back to specific campaigns.

Meta Pixel and Conversions API

We use the Meta Pixel and the Meta Conversions API to measure the effectiveness of our advertising on Facebook and Instagram. When you submit a form or take certain actions on the Services, we may share hashed contact information (such as a hashed version of your email address or phone number), browser identifiers, and event details with Meta. Meta uses this information for ad measurement, attribution, audience building, and (subject to your settings) personalization. You can manage your ad preferences and rights in your Facebook or Instagram account settings.

Managing cookies

Most browsers let you refuse, limit, or delete cookies. Doing so may affect site functionality. You can also use browser settings or platform tools (for example, Meta’s ad-preference settings) to limit advertising-related tracking. Some browsers provide a “Do Not Track” signal; because there is no industry standard for honoring such signals, we do not currently respond to them. Where required by law, we treat applicable opt-out preference signals (such as Global Privacy Control) as opt-out requests for sale or sharing of personal information.

7. Data retention

We retain personal information for as long as necessary to provide the Services and to fulfill the purposes described in this policy, including to maintain customer records, comply with legal obligations, resolve disputes, defend against claims, and enforce our agreements. Quote-form records, including the consent records associated with SMS opt-in, are retained for a minimum period sufficient to support carrier audits, regulatory inquiries, and TCPA-related defense (typically four years from the date of submission), unless a longer period is required by law.

8. Your choices & rights

Email opt-out

You can opt out of marketing emails at any time by clicking the unsubscribe link at the bottom of any marketing email or by emailing office@happyfencecompany.com. We may still send you transactional or service-related messages.

SMS opt-out

Reply STOP to any text from us, or contact us at office@happyfencecompany.com. See section 4 for details.

Access, correction, and deletion

You may request access to, correction of, or deletion of personal information we hold about you by contacting us using the details in section 14. We will respond within the time period required by applicable law. We may need to verify your identity before fulfilling your request.

Advertising preferences

To opt out of interest-based advertising, you can use the tools provided by the Digital Advertising Alliance at optout.aboutads.info, the Network Advertising Initiative at optout.networkadvertising.org, and the platform-level controls offered by Meta, Google, and other advertising partners.

9. State-specific privacy rights

California residents (CCPA/CPRA)

If you are a California resident, you have the right to:

• Know the categories of personal information we have collected about you, the sources, the business or commercial purpose, and the categories of third parties with whom we share it.
• Access the specific pieces of personal information we have collected.
• Request deletion of personal information we have collected, subject to legal exceptions.
• Request correction of inaccurate personal information.
• Opt out of the “sale” or “sharing” of personal information. We do not sell personal information for money. We may “share” personal information for cross-context behavioral advertising as that term is defined under the CPRA when we use advertising tools such as the Meta Pixel; you can opt out of this by emailing us at office@happyfencecompany.com with the subject line “CCPA Opt-Out” or by enabling Global Privacy Control in a supporting browser.
• Limit the use of sensitive personal information (we do not use sensitive personal information for purposes that trigger this right).
• Be free from discrimination for exercising your rights.

To exercise these rights, contact us using the details in section 14. We will verify your request through reasonable means before responding. You may designate an authorized agent to make a request on your behalf, subject to verification.

Florida residents

Florida residents may have rights under the Florida Digital Bill of Rights, depending on whether Happy Fence meets the statutory thresholds. To exercise any rights you may have under Florida law, contact us at office@happyfencecompany.com.

Other state privacy laws

Residents of other states with comprehensive privacy laws (including, where applicable, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others) may have rights similar to those described above, including the right to access, correct, delete, or port their personal information, and to opt out of certain processing. EU/UK/Swiss residents

The Services are intended for residents of the United States. If you access the Services from outside the United States, your information will be transferred to and processed in the United States. If you are a resident of the European Economic Area, the United Kingdom, or Switzerland, you may have additional rights under applicable law, including rights of access, rectification, erasure, restriction, portability, and objection. 10. Children’s privacy

The Services are not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe a child under 16 has provided us with personal information, please contact us at office@happyfencecompany.com and we will delete the information.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. No internet transmission or electronic storage is 100% secure, and we cannot guarantee absolute security.

The Services may include links to third-party websites, products, or services that we do not own or control. This Privacy Policy does not apply to information collected by those third parties. We encourage you to review their privacy policies before providing them with information.

13. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page.
